Care Scribe — Terms of Service

1. Acceptance of Terms

By creating an account, downloading, or using Care Scribe (“the App”) you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please discontinue use immediately.

2. Description of Service

Care Scribe is a documentation, scheduling and invoicing application designed for independent NDIS (National Disability Insurance Scheme) support workers in Australia. It provides voice-to-note transcription, NDIS-aligned invoicing, participant management, shift tracking, and incident report drafting.

Care Scribe is not a registered NDIS provider, does not deliver NDIS supports, and is not a substitute for professional clinical, legal or accounting advice.

3. Important Disclaimer

Voice-to-note outputs, NDIS support category suggestions, incident-flag prompts, and invoice drafts produced by the App are drafts for your review only. They are generated using AI models that may produce errors or omissions. You are solely responsible for reviewing, correcting and approving every record before it is saved, sent to a participant, lodged with a provider, submitted to the NDIS Quality & Safeguards Commission, or issued as an invoice.

4. User Eligibility & Responsibilities

• You must be at least 18 years old and lawfully entitled to provide support work in Australia.
• You agree to provide accurate worker, business and participant information.
• You are responsible for the confidentiality of your account credentials.
• You will obtain any consents required from participants (or their guardians/nominees) before recording sessions or storing their personal information in the App, and you will follow your provider's policies and the NDIS Code of Conduct.
• You are responsible for verifying the accuracy of all notes, incident reports, BAS/GST treatment and invoices before submission.
• You must hold a valid ABN to use invoicing features and are responsible for your own tax and superannuation obligations.

5. AI-Powered Features

Care Scribe uses speech-to-text and large language model technology to convert your spoken recordings into structured progress notes and incident drafts. While we strive for high accuracy with NDIS-aligned templates, AI output may contain errors, hallucinations, or formatting issues. You are responsible for reviewing every AI-generated output and editing it before saving or sharing. Your recordings, transcripts and notes are not used to train third-party AI models.

6. Acceptable Use

You agree NOT to:

• Use Care Scribe to record any individual without lawful consent under applicable Australian state or territory law.
• Upload content that is unlawful, defamatory, or that infringes another person's rights.
• Reverse engineer, scrape, or attempt to derive the source code of the App.
• Misrepresent your professional credentials or NDIS-registration status to participants or providers.

7. Subscription & Billing

• Free Trial: New accounts receive a 30-day free trial of all features. No credit card is required to start the trial.
• Plans: After the trial, Care Scribe is offered at A$12 per month or A$100 per year (GST inclusive). Both plans include the same features.
• Auto-renewal: Paid plans renew automatically until cancelled. You can cancel at any time from inside the App; access continues until the end of the current billing period.
• Refunds: Refunds are handled in accordance with the Australian Consumer Law.
• Pricing may change with at least 30 days' notice; existing annual subscribers are honoured at their current rate until renewal.

8. Data Ownership

You retain ownership of all participant data, notes, recordings and invoices you create in Care Scribe. We hold this data only to operate the service for you and process it solely under your instructions, in accordance with the Privacy Policy.

9. Intellectual Property

All software, designs, branding, logos, and AI templates associated with Care Scribe are the intellectual property of AI..sh AI PTY LTD. Subscription grants you a limited, non-exclusive, non-transferable licence to use the App for the duration of your active plan.

10. Limitation of Liability

To the fullest extent permitted by Australian law, AI..sh AI PTY LTD shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of Care Scribe — including but not limited to loss of NDIS funding, missed reportable-event notifications, incorrect invoicing, or financial losses resulting from reliance on App-generated drafts.

Nothing in these Terms excludes any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law. Where liability cannot be excluded, our liability is limited (at our option) to re-supplying the service or refunding the fees you have paid in the most recent billing period.

11. Termination

We may suspend or terminate access to Care Scribe for material breach of these Terms, fraudulent activity, or conduct that endangers participants or other users. You may delete your account and your data at any time from inside the App. On termination we will delete your personal data within 30 days, subject to legal retention obligations.

12. Changes to these Terms

We may update these Terms as the App evolves. Material changes will be notified in-app and via email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms.

13. Governing Law & Disputes

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales. Before commencing court proceedings, the parties agree to attempt to resolve disputes in good faith via email correspondence.
